1. Agreement to Terms

By accessing or using Zamiweb ("the Platform"), you agree to be bound by these Terms & Conditions. If you do not agree, you may not use the Platform. These terms constitute a legally binding agreement between you and Zamiweb.

2. Eligibility

You must be at least 18 years old to create an account and use Zamiweb. By registering, you confirm that you meet this age requirement and have the legal capacity to enter into this agreement.

3. Account Registration

You register using your Google account. You are responsible for maintaining the security of your Google account and all activity that occurs under your Zamiweb account. You must notify us immediately if you suspect unauthorized access.

4. Free Service

Zamiweb is currently offered as a free service. We reserve the right to introduce paid plans or modify the free tier's features and limitations at any time with reasonable notice. The free plan currently includes up to 10 products, live chat, order management, and a store subdomain.

5. Your Store & Content

You retain ownership of all content you upload to your store, including product images, descriptions, and store branding. You are solely responsible for ensuring that your content does not infringe on any third-party intellectual property rights, violate any applicable laws, or contain prohibited or illegal material.

By uploading content, you grant Zamiweb a limited, non-exclusive license to host, display, and distribute your content solely for the purpose of operating the Platform.

6. Prohibited Uses

You agree not to use Zamiweb to sell illegal, counterfeit, or prohibited goods or services. You must not use the Platform to deceive or defraud customers, distribute malware or harmful code, engage in spam or unsolicited communications, impersonate any person or entity, or violate any applicable laws of Bangladesh or the jurisdiction of your customers.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

7. Payments & Transactions

Zamiweb facilitates the display of payment information (bKash, Nagad) on your store's checkout page. All financial transactions occur directly between you (the store owner) and your customers. Zamiweb does not process, hold, or have access to any payment funds. You are fully responsible for verifying payments and fulfilling orders.

8. Customer Data

As a store owner, you receive customer data (names, phone numbers, addresses, transaction IDs) through orders placed on your store. You are responsible for handling this data in accordance with applicable privacy laws. You must not misuse, sell, or share customer data for purposes unrelated to order fulfillment.

9. Availability & Uptime

We strive to keep Zamiweb available at all times but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience downtime beyond our control. We are not liable for any losses resulting from temporary unavailability of the Platform.

10. Limitation of Liability

Zamiweb is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, revenue, data, or business opportunities arising from your use of the Platform.

Our total liability for any claim shall not exceed the amount you have paid to Zamiweb in the 12 months preceding the claim (which, under the free plan, is zero).

11. Intellectual Property

The Zamiweb name, logo, design, and platform code are the property of Zamiweb. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without our written permission. The storefront themes and templates provided are licensed for use within the Platform only.

12. Account Termination

You may delete your account at any time through your dashboard settings. We may suspend or terminate your account if you violate these terms, engage in prohibited activities, or if your account remains inactive for an extended period. Upon termination, your store, products, and associated data will be permanently deleted within 30 days.

13. Modifications to Terms

We may update these Terms & Conditions at any time. Changes will be posted on this page with an updated date. Continued use of the Platform after changes constitutes acceptance of the modified terms. For significant changes, we will make reasonable efforts to notify you via email or platform notification.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the People's Republic of Bangladesh. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Bangladesh.
